Borislow responds to WPS Suspension, casts doubt on legal fees excuse

Virginia Online Soccer News reached out to Dan Borislow, owner of the magicJack team that has been battling with the WPS since he purchased the former Washington Freedom club.  Borislow is currently taking a lot of blame via social media outlets concerning his perceived role in today's announcement by the WPS that it will suspend the 2012 season.

"We firmly believe there is a place in the global sports landscape for Women's Professional Soccer," said WPS CEO Jennifer O'Sullivan.  "Making the decision to suspend the 2012 season was a difficult and painful one, but it is necessary to take the time to address current issues and solidify our business in order to provide appropriate support needed to achieve the League's long-term goals. Those that take part in our League - players, partners and fans - deserve the best, and that is what we are taking the time to ensure we deliver when we resume play in 2013 and beyond."

In response to the news of the suspension of the 2012 WPS season Dan Borislow said:

"I still expect the WPS to live up to their agreement they made with us and recorded with the Judge a few weeks ago. I was also under the impression that Pal Fulmer, their lawyer, was donating her time or making a contribution to offset any legal expenses of the league. If the league follows through with our deal, I can't imagine why there would be legal expenses. I hope to still put a team together but have to see what happens with a residency camp. magicJack stays committed to helping the US add another Gold medal to it's inventory. We will do practically anything to help the Women achieve this."

Do you believe that the WPS is attempting to use Borislow as a scape goat and try to place the blame of failure to successfully launch the 2012 season squarely on the shoulder of the magicJack owner?

SUSPENDS PLAY FOR 2012 SEASON


SAN FRANCISCO, CA (January 30, 2012) – Women's Professional Soccer (WPS) announced today that its Board of Governors has voted to suspend the 2012 season to permit the League to focus on the resolution  of certain pending legal issues and  the challenges that now face the League as a result of its ongoing dispute with a former owner.

"We are proud of what the League has accomplished in the first three seasons, but we do recognize the necessity to resolve our existing legal and operational issues so that we can continue to support and grow WPS the right way," said Sky Blue FC Owner Thomas Hofstetter. "This was a very difficult decision, but one we as owners feel is the best business decision for the League at this time."

The Board voted on Monday morning to suspend the 2012 season.  Over the last year the league has faced significant challenges, including a lengthy and expensive legal battle with a former owner.  The litigation has diverted resources from investment in the league and has forced the Board to take action, suspending the 2012 season in order to address the legal issues head-on before moving forward with competition.

WPS has established its plans to return to play in 2013, and all five owners of the League's existing teams - Atlanta Beat, Boston Breakers, Philadelphia Independence, Sky Blue FC and Western New York Flash - will remain active with the CEO, Jennifer O'Sullivan, in the governance of WPS throughout the current year.

"We are deeply grateful to our fans and partners for the tremendous support they have shown for WPS, our players and the sport," added O'Sullivan.  "With our supporters and athletes in mind, we are committed to complete the hard work necessary to resume play in 2013 and reestablish WPS as the premiere women's professional soccer league in the world."

OFFICIAL Response From Dan Borislow

The following is an offical unedited response directly from magicJack owner Dan Borislow in response to the WPS statement released earlier today:

The management of the league is a lot better at lying than running a professional sports league.If you read my request for injunction,you will see that I signed this under penalty of the law.I am sure they would not do the same.Although this does not contain near all the issues ,it gives a good indication of what I have been going through and I suggest you read it.

It is ironic that the person being quoted for the league ,is the same person paying players an amount below the poverty line.Further,the comments about the players are an absolute lie.There isnt one player we know of that signed the grievance and the National team players were shocked to see it after the fact.We cut six players in a short period of time,and I am sure between them and a conspiracy with the league that is where the grievance eminated. My players are the highest paid players with the best benefits.Although they are the highest paid, Abby, Hope, Christie and Megan combined do not make what Anne Marie makes and that is a crying shame.

The largest lie,is similar to what happened during the World Cuop,where the National team members got an email before the Brazil game threatening them with not having a job and a place to sleep.I refused to answer this grievance while the women were away at the World Cup,no matter what penalty they would give me.I refused because I did not want them distracted where the league and the Union couldn't care less.The largest lie is they were not threatening to take the team away at the end of the season like their letter purports,they were going to take away the team this week.

Lastly, lets figure out who was right and wrong about what is best.We have sold out every stadium we play in without any advertising.I begged them not to play while the World Cup was going on.I said it's like me selling a phone service ,but only offering incoming calls and not outgoing calls.How many times would you try it.One and done is the answer.The attendance and the product were absolutely terrible during the World Cup.On top of it,the attendance is a huge lie.The paid attendance is probably half of what you see on the site and some teams just outright inflate the attendance.Meanwhile,the league is selling franchises based upon these numbers and I absolutely refuse to be part of that too.It's fraud,just like the way they induced me into the league.So anyway,I told the league you must embrace the WNT and it's players,it's our only hope.I was talking into deaf ears for the most part.I donated my field and hotel rooms to the WNT for three weeks before they went to Germany and did almost exactly what I thought best for the WNT.That is our bread and butter.So all those Borislow this and that and all their lies,who was right?Who wants our team in their stadium?Who got the attendance for their games?who is showing the best product to the audience?

So the good news I guess,Is that the WPS changed their mind and doesn't want to screw up US soccer and the beautiful sport during the year after reconsidering how much damage it would do.I beggeed them for months to not let this happen and told them how stupid they were.Isnt it further ironic,that the thing I got penalized for was the lack of contact with the media,but when I wanted to tell the truth and talk to the media,they wanted to take our team.They just wanted to keep on getting their paycheck and not come up with a sound business model and take the shortcut and find some other suckers.They should have embraced the WNT ,come up with a sound business model and presented it to the USSF to get help.If I was the USSF,seeing this league flounder around like this with these hateful clueless people and ridiculous overhead,(God man,we have only 50 or so games and each one cost us $20,000.00 in league overhead alone)I wouldn't go near this with a 1,000 foot pole.

I challenge anybody from the league to get on a lie detector test with me.Who are they to challenge me anyway when they leach off soccer and collect money,when I have in essence donated over $1.5 million to soccer.I Love this sport,it is my salvation and solitude.It is everything that is good.

This response was written within minutes and is all over the place,feel free to post it anyway.I just wanted to add,I know that Boston,New York,New Jersey and some degree Philadelphias heart is in the right place.They have been drug around by a group of haters and bottom feeders.It is no wonder why so many teams bailed and two of the owners have stayed completely out of this mess.

Former Washington Freedom franchise battling WPS to Survive

Do you ever wonder "What happened to the Washington Freedom?" Well, ever since Dan Borislow has taken over the team it has been what one could only describe as "strange" and "unbelievable" and the latest chapter in the saga of Borislow vs. WPS has just reached a new level as the Women's Professional Soccer League released the following statement today:

Women's Professional Soccer (WPS) holds all teams and owners to a uniform professional standard, and all owners must agree to those standards in order to play in the League. When Dan Borislow took over as the majority owner of the Washington Freedom (now magicJack) franchise, Mr. Borislow had an obligation to follow, and embrace these standards and to honor the franchise's commitments to the League, players and sponsors.

Mr. Borislow has failed to honor his commitments to the detriment of the League, our players and our partners. From unprofessional and disparaging treatment of his players to failure to pay his bills, Mr. Borislow's actions have been calculated to tarnish the reputation of the League and damage the League's business relationships. Now, Mr. Borislow has filed a baseless legal action against WPS. The League is not intimidated by Mr. Borislow's unfounded claims and will not tolerate his mistreatment of players and flouting of the rules.

Mr. Borislow is asking a Florida court to bar the League from exercising its right to terminate his franchise at the end of the season for breach of his contractual obligations. No such entitlement exists under League contracts, and Mr. Borislow's many contractual breaches more than justify any decision by the League to terminate his franchise.

"It is disappointing that rather than run a professional organization and partner with his fellow owners, Mr. Borislow has chosen to threaten the League by filing this action," said WPS Board Chairman and Atlanta Beat Owner, T. Fitz Johnson. "All of us at WPS are involved in this business because we love the sport, we are committed to our incredible athletes and fans, and we know that there is a permanent place in sports for the women's professional game."

"We continue to focus on our world-class athletes and their accomplishments, and we won't let the antics of one owner steal the moment from them and from our fans," said Anne-Marie Eileraas, CEO, Women's Professional Soccer. "We will defend the League against Mr. Borislow's latest attack and will continue to hold all of our teams to the same professional standards in order to protect our players, fans, teams, partners and the integrity of the sport."

WPS Responds to magicJack owner infractions and statements

Today following many issues dealing with magicJack owner Dan Borislow, theWomen's Professional Soccer league has released an official statement regarding the recent sanctions imposed on the former Washington Freedom franchise, now called magicJack.

WPS OFFICIAL STATEMENT:

SAN FRANCISCO, CA (May 14, 2011) -Warning the owner of the magicJack women's soccer club that it will not tolerate his contractual failures and disparaging statements, Women's Professional Soccer took action to ensure the team can meet obligations.

The League said today that it will contract directly with vendors for field boards and match video systems so that the team can meet obligations and will bill the team for this action.

The team staged its first three home games without complying with several league rules, including those requiring display of sponsor field boards and submission of match video. The League said that unless team ownership immediately improves and adheres to League standards, further sanctions will be immediate and swift.

"Women’s Professional Soccer is committed to be the premier women’s soccer league in the world. WPS has taken, and will continue to take, appropriate measures to protect the integrity and future of the league and our brand," said CEO Anne-Marie Eileraas.

"When Mr. Borislow purchased an ownership interest in the Washington Freedom, he bought an organization with existing obligations to the league and others. All owners and teams must comply with the league’s operating guidelines, which represent the commitment of WPS and its owners to a high standard of quality and professionalism.

"WPS has offered the team (re-named magicJack) ample time, options and assistance to ensure that all league standards were met. To our disappointment, the team has failed to meet these standards, and instead of working with his partners to address those failures, Mr. Borislow has chosen to make public statements that reflect a blatant disregard for the truth and are damaging to the best interests of the league. In penalizing the team, WPS has not acted without cause or precedent, and has only taken the action necessary to enforce the regulations of the league," Eileraas said.

"We will not allow any individual to diminish the quality and value of our league. WPS and its Board of Governors are committed to preserving the integrity of our game, and will take immediate action – including taking over certain functions the team has failed to manage -- to protect the best interests of the team, the league, fans, players, and sponsors, and to return the focus where it should be: on the unparalleled play on the field," said T. Fitz Johnson, chair of the WPS Board of Governors.

magicJack Owner Dan Borislow responds to low attendance

After only four weeks of action the attendance figures for the WPS are looking very bleak.

Jenna Pel of AllWhiteKit.com is reporting that league wide average attendance this past week was only 1,987.

The former Washington Freedom franchise now known as magicJack is not helping those numbers at all. The first home game for magicJack drew a reported 1,224 fans at FAU in Boca Raton, FL. This past weekends attendance was anywhere between 500 to 1,008.

Even taking the highest number for magicJack, the league seems to be in dire trouble.

VaSoccerNews.com reached out to the owner of magicJack, Dan Borislow, for comment on plans to turnaround the declining attendance figures so far for magicJack?

Borislow also responded to the issue of the team having no website, advertising, or merchandise and how he plans to promote or even make money from his WPS franchise?

"Until people know you have a good product, it is a difficult sale.We will grow the attendance in the second half of the season. Further we had a late start and wanted to make sure everybody was ready for larger attendance at FAU. Lastly, sponsorships are not ploys, they are a necessary part of building a financially successful team." said Borislow.

The final part of the response from the magicJack owner was surely in response to our question/suggestion:
Was this all just a huge marketing ploy for your magicJack company rather than an honest attempt to run a successful women's soccer franchise?

Do you think the WPS is in serious trouble? Will attendance turn around during the second half of the season as Dan Borislow suggests? And finally, would professional women's soccer as a product be better served by the WPS joining forces with the existing USL W-League and simply grow the long running W-League?

Washington Freedom/magicTalk SC to play at FAU?

According to a recent article on FAUOwlACCESS.com, Dan Borislow may finally have a location in Florida to play home games as magicTalk SC.


From FAU website:

FAU Soccer Stadium was completed as part of a 10-year development program to create five on-campus soccer fields in conjunction with the Greater Boca Raton Beach Tax District. FAU hosted the Atlantic Sun Conference women's soccer championship in 2000 and 2003 and the University has served as a practice site for several international teams, Team USA and the women's soccer professional combines. Recently, FAU faced the Colorado Rapids and Real Salt Lake during the MLS team's spring training at the FAU Soccer Complex.


There still where rumors of the team possibly playing two home games in the D.C. area but no venue has been 'officialy' announced.

Dan Borislow, Q & A with Washington Freedom Owner


I recently had a brief exchange with the new Washington Freedom/Magic FC? owner, Dan Borislow. As you can tell from the responses he is not much for long winded answers and fans should finally get to see which direction Borislow is taking the team in 2011 by next week.

VaSoccerNews: Why not move the team to Florida immediately?
Dan Borislow: I want to see where the most fans come out

VaSoccerNews: Why chose to change the team name as opposed to a simple Shirt Sponsorship?
Borislow: Because it is my team

VaSoccerNews: Does your background in youth soccer influence your decision to become part of the WPS and why/how do you see the league succeeding beyond its third year?
Borislow: Soccer as a sport must become larger and the parents must become smart enough to want to take their kids to games so they may watch professional soccer and become better players.

VaSoccerNews: Who is the teams main target audience, women, youth?
Borislow: Everybody.

VaSoccerNews: How important is it to sign Marta to the club? Are you concerned with the history of the teams Marta was a part of (folding)?
Borislow: Marta has nothing to do with teams folding,owners do.Marta should be in our league.

VaSoccerNews: Will the 2011 Women's World Cup have a significant impact on the WPS? If so how?
Borislow: It will only help if the US does well.

VaSoccerNews: Any progress on the GM/Coaching front?
Borislow: Yes.

VaSoccerNews: It has been very quit in the Freedom front office, do you have a message for the fans?
Borislow: Next week.


I will be attending the WPS Draft in a couple of weeks and will try to follow-up with Dan Borislow regarding these questions as well as any transactions that may or may not happen between now and January 14th.

New Washington Freedom owner is...

  

In an official Statement from Washington Freedom Chairwoman Maureen Hendricks, Dan Borislow was named the new controlling partner of the Washington Freedom.

Borislow does have ties to soccer in Florida, see magicJack Hot Shots and Magic Jack Field.

Hopefully other investors will follow suit and step up to support the WPS as a league and the other struggling franchises.
